Delhi govt drafts rules for tech aggregators

The Delhi government issued a proposal scheme on Monday to regulate the transportation activities of various tech companies in the NCR, including food delivery, mobility, and e-commerce.
The law applies to all such vehicles operating in Delhi.

The draught was created in collaboration with 40 companies, including Ola, Uber, Flipkart, Amazon, Bluesmart, Bounce, and Ninjacart.

All aggregators will be granted a permit to operate in the region.

The draught focuses on electrification, pricing transparency, and access to data—such as the number of drivers on the road, vehicle quality, driver ratings, and movement—as well as ensuring adequate customer care service in some of the other areas the government is looking to regulate.

“We feel that because of these digital intermediaries there has been an explosion in the number of vehicles on the road,” said Ashish Kundra, principal secretary, department of transportation, GNCT Delhi. “Gig workers have bought second-hand vehicles and have onboarded themselves onto these platforms. We think they have an obligation towards sustainable mobility.”

The draft was released soon after the conclusion of a virtual roundtable meeting on Monday chaired by Transport Minister Kailash Gehlot. Over 100 participants from 40 companies were also present during the round table.

The aggregators have been asked to set up a command and control centre to monitor the movements of all drivers on the aggregator’s roster.

The aggregator would need to provide remedial training and corrective measures to driver partners with ratings less than 3.5 over the course of a year.

The electrification of the fleet has been prioritised. Within one year of receiving a licence, 50 percent of all new vehicles added for two-wheelers and 25 percent of all new vehicles added to the four-wheeler fleet should be electric.

Kundra said that the draft has been prepared based on the guidelines issued by the Ministry of Road Transport and Highways in 2020 to regulate aggregators. “Delhi is the first to create its own framework based on that template,” he said. “We have tweaked it to the realities of Delhi, based on a series of consultations.”

The Department of Environment directed the Department of Transport last week to ensure the transition to electric vehicles.
